Simply Catering Equipment are committed to being as open and as honest with our customers as possible. Here you will find our full terms and conditions for using this website, delivering products and getting in touch with us.

Business to Business

Simply Catering Equipment are suppliers of catering equipment and services to commercial customers and all sales are considered a business to business contract.

Suitability of the Goods

Goods are not supplied on a trail basis. It is your responsibility to ensure that the goods that you order are suitable for your requirements and the purpose for which you intend to use them before you place your order. It is your responsibility to ensure that the goods ordered will fit through passageways and doorways to reach the intended location. It is your responsibility to ensure that services such as drainage, power supplies and connections are appropriate for the goods supplied and that the water softeners are fitted in hard water areas. All gas powered goods must be fitted by a GAS SAFE approved fitter and all electrical goods by a qualified installer. Simply Catering Equipment will accept no liability for damage to goods or any other liability or loss caused by incorrect fitting or installation.

Simply Catering Equipment take all reasonable care to ensure that all descriptions, details and specifications are accurate. However, all sizes, colours, dimensions and measurements should be treated as being approximate. Full detailed specifications and further advice are available on request.

Stock availability

Here at Simply Catering Equipment we try as hard as possible to let you know the availability of an item via the website. However, there may be occasions when a product is not available and this is not reflected on the site. If this is the case, we will get in touch with you as soon as possible to resolve the issue and discuss an alternative solution such as; when it will be back in stock, an alternative product or simply refund your order so that you can order the product elsewhere. You must not use, fit or install any damaged or incorrectly supplied goods whether notified to us or not. If you do, you will be deemed to have accepted the goods and Simply Catering Equipment will accept no further responsibility in relation to such goods.

All transactions on the Simply Catering Equipment website go through Stripes merchant gateway or PayPal None of your payment details are stored on the website, so that your information is kept extra safe. For more information, visit our secure shopping page.

Warranties and Liability

If you identify any fault or issue with your product after you have purchased it, your first port of call should be the manufacturers user manuals that we provide. You can also contact the manufacturer directly or get in touch with Simply Catering Equipment if the troubleshooting guide offers no solutions.

If your item requires a warranty call, please follow our warranty procedure detailed with your purchase. For more information about warranties, please read our warranty information page.

In the event of a failure or breakdown of the goods supplied within the warranty period you must inform us as soon as you become aware of the defect or failure and in any event before the expiry of the warranty period. Simply Catering Equipment will not accept responsibility for any defect or failure of the goods notified after the expiry of the warranty period whenever the defect or failure occurred.

Simply Catering Equipment’s product warranty stated on the website product page, order confirmation email and invoice email overrides any warranty details printed in a manufacturers brochure or found on any other external media including but not limited to a product manufacturers website or brochure.

We reserve the right to take a debit or credit card or other type of payment in advance of arranging a warranty service call. The payment will be refunded if the fault is covered by the manufacturers warranty but will be retained if the product fault or defect is not covered. Examples of exclusions include, but are not limited to; incorrect installation, damage, misuse or lack of maintenance including descaling and cleaning.

Simply Catering Equipment is not liable for any lost profits or business interruption that may have directly, indirectly or incidentally arisen from a faulty or defected unit. It is the customer’s responsibility to plan and prepare for such instances.

The Customer agrees that Simply Catering Equipment will not be liable for any losses or damage suffered by the Customer including but not limited to damage to neighbouring or connected items or premises, consequential loss, loss of business, business interruption or loss of time due to the use or purchase of the Goods by the Customer. Simply Catering Equipment will not be liable for any additional damage caused by the Customer’s failure to report a fault or defect in good time or failure to provide reasonable access to the Goods for repairs, service or engineer visits. Nothing in this agreement shall exclude Simply Catering Equipment statutory liability for injury or death.

Parts only warranty

A parts only warranty allows you to use your own sourced fully qualified engineer (at your own cost) to assess the problem. This must be followed by a full engineers report sent back to ourselves, which we will then forward onto the product manufacturer. Once approved by the manufacturer the parts required will be sent to your specified location. The manufacturer requests that the defective parts are to be sent back on repair of the unit. Failure to send these defective parts back is unacceptable and will result in a full invoice for the replacement parts.

For equipment installed into a mobile catering unit, a non mainland UK premises or an offshore site will invalidate the standard manufacturers warranty stated on our product pages within this website. In some instances the manufacturers warranty may be limited to a parts only warranty. Please call our office for further information.

Back to base warranty

Customers must arrange for any faulty unit(s) to be returned to the manufacturer for repair when the items are covered by a back-to-base warranty. Please ensure that the item(s) are well packaged as neither Simply Catering Equipment nor the manufacturer will accept any responsibility for any loss or damage caused due to poor packaging when the item is in transit.

Please contact Simply Catering Equipment to obtain a returns number for your package from the manufacturer. You will need to complete our warranty request form, which requires your signature and an original invoice number. This can be downloaded from our website.

Customer Feedback

We love to hear your feedback and we are very open to any suggestions you may have. Any comments or feedback that are submitted to Simply Catering Equipment will be dealt with as soon as possible. Please note that once submitted, it becomes part of Simply Catering Equipment’s property and will not be treated as confidential.

Delivery of goods

Simply Catering Equipment do as much as possible to ensure that goods are delivered to you on time and within the estimated delivery date on the website. However, Simply Catering Equipment is not liable for any delays.

Delivery will be to kerbside only unless prior arrangements have been made. The delivery person/driver may at his/her discretion assist with delivering the goods to a location within the premises nominated by the customer, at the customer’s sole risk.

Deliveries take place between the hours of 8am-6pm Monday to Friday.

For large items the chosen delivery address must be accessible by an 18ton lorry, please contact Simply Catering Equipment if your site has any access restrictions. Failure to disclose such information may result in extra costs being incurred by a failed/aborted delivery.

When a product is delivered to you, the first thing you must do is inspect the goods for any damage. Failure to check the goods and document any damage with the driver will result in a claim for damage being rejected. Signing unchecked is not acceptable. In the event that the driver will not wait for you to inspect the goods, please sign for as ‘Damaged’. Once signed as damaged, you must report the damage to Simply Catering Equipment in writing within 24 hours to make a claim. If an item has been installed this would deem the product being accepted by the customer and claims for damages may also be rejected. 

Delivery does not include the removal of old units or disposal of packaging materials (pallet, wrapping etc…). Collection and disposal of old units can be selected on a number of our products, in such cases where this service has been requested you must ensure that the items have been unplugged, disconnected, emptied, cleaned and made ready for collection outside of the premises.

We will charge a redelivery fee if no one is available on site to take delivery of the goods.

A 25% restocking fee of the items value will be charged if delivery fails due to any of the points above, or if the product is returned and is not faulty. Please note that once an order has been placed and despatched the restocking fee will still apply.

Please DO NOT book any fitters or installers of the equipment ordered until after the goods have been delivered and inspected by yourself. We will not take any responsibility for any costs incurred as a result of arranging this in advance of delivery.

Customised / made to order goods

When customised or bespoke goods are ordered we will not accept ANY returns. You are responsible for ordering suitable goods for your requirements. If however the goods are damaged, you may be able to make a claim against the manufacturer or supplier if you have inspected and signed the goods as damaged upon delivery. No claims against damage will be accepted if you have signed for goods without indicating any damage.

Returns

Goods sold in the UK mainland may be returned at the customers own cost for a refund providing the product(s) are unused and in their original packaging (this includes any laser film). This excludes customised / made to ordered goods (See above). The restocking charge for returned items is 25% of the full invoiced amount. No goods are accepted for return after 14 days from purchase date.

Please note, once an order has been placed and despatched the 25% restocking fee will still apply.

Refunds will only be paid once the returned goods have been inspected and after deduction of any restocking charges have been made. We will also deduct any costs for repairing any damage or replacing any missing components that were supplied with the original order.

Retention of Title

Notwithstanding that the goods have been delivered and accepted by you the ownership or legal title to the goods will not pass to you until you have paid in full for the goods supplied and there are no other sums of money due from you to Simply Catering Equipment. Until this time you will store or mark or keep the goods supplied in such a way as to make them clearly identifiable as our property.

Until such time all sums due to Simply Catering Equipment have been paid in full you will at Simply Catering Equipment’s request deliver up the goods and you acknowledge that Simply Catering Equipment will be entitled to enter any premises owned or occupied or controlled by you where the goods are situated for the purpose of recovering and repossessing the goods.
